Blazin' Mongolian BBQ Raffle Rules
RULES & REGULATIONS FOR the Blazin' Mongolian BBQ RAFFLE
These are the Rules & Regulations (“Rules”) for the Blazin' Mongolian BBQ Raffle (the “Raffle”). By purchasing a Raffle ticket and entering the Raffle, you agree to be bound by these Rules and the decisions of Blazin' Mongolian BBQ “Sponsor”). Void where prohibited. All state, federal and local laws, rules and regulations apply.
ELIGIBILITY: You must be eighteen (18) years of age or older at the time you purchase the Raffle ticket to be eligible to win whether you are purchasing the ticket individually or on behalf of a business entity. Raffle tickets can be purchased by individuals or by a business entity by its duly authorized legal representative. The original Raffle ticket purchaser must be present in the state of Arizona at the time of purchase of the Raffle ticket. Employees of the Sponsor, and its parent companies, affiliates, subsidiaries, chapters, divisions, and advertising and promotion agencies (collectively the “Raffle Entities”), and the immediate family members or persons living in the same household of such employees, are not eligible. For purposes of the Raffle, “immediate family members” include an entrant’s spouse, children,
siblings, parents, grandparents, and grandchildren.
HOW TO ENTER: Raffle tickets may be purchased directly from Sponsor prior to the event or the day of the event
One (1) Raffle ticket can be purchased for $10 and a group of ten (10) Raffle tickets can be purchased for $80. It is not necessary that an entry purchaser be a resident of the state of Arizona, but an original Raffle ticket purchaser must
be physically present in Arizona at the time of entry purchase. Only one (1) individual may be identified as an entry purchaser. All Raffle tickets are non-refundable.
DRAWINGS/ODDS: The winner of the Raffle will be selected by a random drawing of all validly issued tickets on or about March 25, 2017. The odds of winning depend on the number of tickets sold. The random drawing will be administered by Sponsor. PRIZES: Prize(s) will be posted on the website blazinmongolianbbq.com prior to the event. The prize(s) will be awarded as is, with no written or express warranty. The prize is not transferable except with the permission of Sponsor. Prizes may not be substituted nor redeemed for cash.
NOTIFICATION OF WINNER: The potential winner will be notified by email at the email address provided when purchasing the Raffle ticket of the requisite procedure to claim the prize. The potential winner must respond within three (3) business days of notification to confirm their acceptance of the prize and present proof that they are the purchaser of the Raffle ticket. If the potential winner does not meet these requirements or if any prize notification is returned as undeliverable, that potential winner will be disqualified and an alternative potential winner
selected from the remaining Raffle tickets. No person shall be declared the winner until they meet all the requirements of these Rules. In the event of dispute over the winner, the winner will be the authorized account holder of the mail account used to submit the comment will be deemed to be the entrant. The authorized account holder is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
PRIVACY: By entering the Raffle, ticket purchasers agree that their contact information provided in connection with the Raffle ticket purchase may be used for communications promoting the Raffle and future Raffles sponsored by or conducted for the benefit of Sponsor. A Raffle ticket purchaser may subsequently "opt-out" of the receipt of such communications by following the directions in any e-mail or other communication. Other than as provided herein, a
Raffle ticket purchaser's information will not be shared with or sold to any other person or entity. Purchase of a ticket in the Raffle, constitutes permission for the Raffle Entities to publish winner's name, location (city and state) and prize won for purposes of advertising the Raffle or future Raffles without further consent or compensation, unless prohibited by law.
REQUIREMENTS: The winner may be required to execute and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (the "Affidavit/Release"). The Affidavit/Release must be returned by the deadline stated in such document. Until the requested Affidavit/Release is returned, the winner is only a presumptive winner. If the presumptive
winner fails to return such documents by the return deadline, or if an entrant is found to be ineligible, or if a presumptive winner does not comply with the Official Rules, then the presumptive winner will be disqualified and the prize or a cash equivalent will revert to Sponsor.
WAIVER / LIMITATIONS OF LIABILITY: Raffle Ticket purchasers, by participating (and winner, by accepting a prize), release the Raffle Entities, and each of their respective directors, officers, partners, employees and agents, including advertising and promotion agencies, from any and all liability with respect to participation in the promotion, possession, use and distribution of the prize(s) awarded.
ADDITIONAL RESTRICTIONS: Any attempt by an entrant to deliberately damage any online service or website, or otherwise undermine the legitimate operation of the Raffle is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Raffle is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of students, technical failures or any other causes beyond the control of the Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Raffle, the Sponsor reserves the right at its sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify, or suspend the Raffle and/or award the Prize from among all eligible, non-suspect Raffle tickets sold as of
the date of the termination, as the Sponsor determines in its sole discretion. No correspondence regarding entries will be entered into with entrants other than the potential winner.
DISPUTE RESOLUTION: BY ENTERING THE PROMOTION, ENTRANTS AGREE THAT:
(1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION IN A COURT OF COMPETENT JURISDICTION LOCATED IN THE STATE OF ARIZONA; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), NOT TO EXCEED THE PRICE OF THE RAFFLE TICKET, BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ENTRANTS BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANTS HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, ONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED THE COST OF THE RAFFLE TICKET, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND YOU IRREVOCABLY WAIVE ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR ONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
TAXES AND IRS RULES: The winner shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prize. SPECIAL NOTE: At the time of this printing, federal law requires that corresponding tax withholding on prize values of $5,000 or greater must be collected from winners upon award and distribution. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are claimed will be followed. The IRS has taken the position that amounts paid for chances to participate in Raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution.
